Terms of Use for HypeClips

1. Acceptance of Terms

By accessing and using the HypeClips application ("App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this App.

2. Changes to Terms

HypeClips reserves the right to modify these Terms of Use at any time. We will notify you of any changes by posting the new Terms of Use on this page. You are advised to review this Terms of Use periodically for any changes.

3. Use of the App

You agree to use the App only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the App. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the App.

4. User Content and Conduct

By using the HypeClips App, you agree that you will only upload videos and content for which you have the necessary rights, permissions, or licenses. You warrant that you own or have obtained all necessary rights, licenses, consents, and permissions to use and authorize HypeClips to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any content you submit or upload.

You further agree that you will not upload any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

HypeClips reserves the right to remove any content that violates these terms or is deemed inappropriate at our sole discretion. You are solely responsible for the content you upload and the consequences of its transmission or publication.

5. Intellectual Property

All content, trademarks, and data on the App, including but not limited to text, software, photos, graphics, videos, music, and sound, are the property of HypeClips or its content suppliers. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the App without express written permission by HypeClips.

6. Limitation of Liability

HypeClips will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the App, or for the cost of procurement of substitute goods and services, or resulting from any goods or services purchased or obtained, or messages received, or transactions entered into through the App, or resulting from unauthorized access to or alteration of your transmissions or data, including but not limited to, damages for loss of profits, use, data, or other intangible.

7. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.
